On February 1, 2025, Secretary of Homeland Security Kristi Noem announced the termination of the 2023 TPS designation for Venezuela, effective April 7, 2025. The termination was set to leave many individuals vulnerable to deportation and without legal work authorization.
Legal Intervention
However, on March 31, 2025, the U.S. District Court for the Northern District of California issued an order postponing the termination of the 2023 TPS designation for Venezuela. Judge Edward Chen ruled that ending TPS would cause significant harm to individuals and the U.S. economy. He noted that the government’s arguments for termination appeared baseless and potentially racially motivated. This injunction allows Venezuelan TPS holders to retain their status while legal proceedings continue.
Current Status
As a result of the court’s decision, the Department of Homeland Security (DHS) reverted to the Federal Register notice published on January 17, 2025, which had extended TPS for Venezuela for 18 months, from April 3, 2025, to October 2, 2026. This extension permits eligible Venezuelan nationals to re-register and maintain TPS through October 2, 2026, provided they meet all eligibility requirements.
Individuals who received TPS during the 2023 designation period have until September 10, 2025 to re-register. It is important to re-register as soon as possible.
Employment Authorization
In compliance with the court order, U.S. Citizenship and Immigration Services (USCIS) announced that certain Employment Authorization Documents (EADs) for Venezuelan TPS beneficiaries are automatically extended through April 2, 2026, pending further litigation. This measure ensures that individuals can continue their employment without interruption during the ongoing legal proceedings.
