If you are residing in the United States and wish to apply for permanent residency (also known as applying for a green card), you must go through a process called Adjustment of Status.

In order to apply for Adjustment of Status, you must first be eligible under one of the many immigration categories set forth by USCIS.

How do you Qualify for a Green Card?

If you are a non-citizen looking to stay in the United States, you’ll need a green card. A green card grants you lawful permanent residence and gives you the opportunity to pursue naturalization or citizenship.  You may apply for Adjustment of Status:

How long is the Adjustment of Status processing time?

The processing time for an adjustment of status is several months. If you want to check your immigration case’s processing time, USCIS has a resource here.

If you haven’t already received visa petition approval, there are additional forms you will need to submit based on your individual situation. Please keep in mind that this can add processing time.  Our experienced immigration lawyers are here to assist you during this process to ensure all documentation is organized and the proper forms are completed to minimize processing time or avoid denial.

Once you submit your packet, USCIS will review it for completeness.  You will be asked to visit a local USCIS office within a certain amount of time to submit your biometric information, which is where you will provide your fingerprints, photographs, and signature. This information is used to verify your identity and conduct the required background and security checks. 

A determination will then be done on your case to see whether an interview is necessary.

What happens at the Adjustment of Status interview?

If necessary, after submitting your application packet, USCIS will call you, and possibly your petitioner (the U.S. citizen, resident, or employer who submitted your visa petition), for a required interview.

During the interview, a USCIS officer will review your application and ask you questions under oath to determine your eligibility. You must bring originals of all documentation submitted with your application.  

Can you stay in the United States while waiting for a green card or adjusting status?

You may stay in the U.S. once your application has been submitted until you hear back from USCIS. This applies even if your permit to stay ends while USCIS is reviewing your application.
